|Jordak has adopted the following policies regarding the purchase and sale of their products. Accordingly, these policies prevail in all business transactions.
Order Processing Our products are made specifically for each customer. We make every effort to ship these products within 72 hours of receiving your order. Please make sure that the spelling and punctuation on your custom plate is accurate before placing the order. We manufacture custom products in compliance with customer’s specification and are not responsible for misspelled words or punctuation.
Shipping Policy We ship every order FOB our warehouse. Products are shipped either UPS or USPS based upon your order request. Time in transit of your order depends upon your location and type of shipment. Any extra charges incurred for additional services such as customer’s carrier or special handling by the carrier must be paid by the customer. Title and risk of loss pass to the customer upon tender of the shipment to the common carrier. If product is damaged in transit, customer must file claim with the carrier.
Cancellation Any cancellation must be approved by Jordak, and may be subject to restocking fees and/or other charges.
Assignment Customer shall not assign any order or any interest therein without the written consent of Jordak. Any actual or attempted assignment without Jordak’s prior written consent shall entitle Jordak to cancel such order upon notice to the customer.
Pricing Policy A price list is available upon request. Prices are in US dollars and are subject to change without notice. All orders are accepted subject to the pricing in effect at the time of order.
Terms of Payment For customers with established credit, terms are net thirty (30) days from date of shipment. (Same as invoice date). If payment is not made within 30 days, Jordak has the right to defer current shipments until payment is made, or may add a service charge equal to 1.5% of the unpaid monthly balance until the payment is made. Granting of credit status is subject to Jordak’s approval and requires submission of a credit application.
If credit is not established, payment must be made at the time of sale using a Visa, Mastercard, Discover or debit card. All payments must be made in US Dollars. Jordak will not ship any orders COD unless previously approved.
Credit Balance Customer agrees that any credit balance(s) issued will be applied within one (1) year of its issuance. If not applied or requested within one (1) year, any balance(s) remaining will be subject to cancellation, and Jordak shall have no further liability.
Sales tax Jordak is subject to the California (CA) Sales and Use tax law and as such is required to charge sales tax on any sale delivered within CA for which a valid exemption/resale certificate has not been provided. Likewise, any drop shipment to an end user in CA will be taxed at Jordak’s sales price plus 10% unless a valid CA resale certificate is provided. For sales delivered in CA but outside San Diego County to end users, the current CA state rate will be charged. For sales delivered inside San Diego County, the current CA state rate plus San Diego County add-on rate will be charged.
Return Policy No merchandise is to be returned without written authorization from Jordak. Merchandise returned without authorization will be refused. We will not accept or pay any freight collect charges for any unauthorized shipment. Call our Customer Service at 800.397.9136 for more details.
Force Majeure Jordak shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions, or any other circumstances or cause beyond the control of Jordak in the conduct of its business.
Modification of Terms Jordak’s acceptance of any order is subject to customer’s assent to the terms and conditions set forth in Jordak’s documentation, and purchaser’s assent to these terms and conditions shall be presumed from purchaser’s receipt of Jordak’s acknowledgment, or from purchaser’s acceptance of all or any part of the goods or services ordered. No addition or modification of terms and conditions shall be binding upon Jordak unless agreed to by Jordak in writing. If a purchase order or other correspondence contains terms or conditions contrary to the terms and conditions contained in Jordak’s acknowledgment, Jordak’s acceptance of any order shall not be construed as assent to any additional terms and conditions, nor will that constitute a waiver by Jordak of any of the terms and conditions contained in Jordak’s acknowledgment.
Waiver, Choice of Law and Venue The failure of either party to assert a right here under or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent nonperformance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of California, excluding conflict of law rules, and venue shall be in San Diego County, State of California.
No Third Party Benefit The provisions stated above are for the sole benefit of the parties hereto, and confer no rights, benefits or claims upon any person or entity not a party hereto.
